3.1 Telehealth Treatment Programs
DocSearch Health Solutions LLC operates a technology platform facilitating patient access to physician-supervised Treatment Programs through TelegraMD’s technology platform for certain medical conditions, including but not limited to weight management (GLP-1 therapies), erectile dysfunction, testosterone replacement therapy, and hormone therapy. These services connect patients with independent licensed physicians employed or contracted by the Provider Groups who evaluate, diagnose, and treat patients at their sole discretion. All clinical services are provided exclusively by the independent Provider Groups. DocSearch does not provide any clinical services.
IMPORTANT: DocSearch Is a Technology Platform — Not a Medical Provider DocSearch is a non-clinical facilitator. We help you access healthcare services provided by independent licensed physicians. We do not practice medicine, employ the physicians who treat you, or own or operate any pharmacy. All clinical decisions are made exclusively and independently by licensed Providers employed or contracted by the Provider Groups. |
3.2 Physician Search Directory
DocSearch provides a free, publicly accessible search tool that allows users to locate licensed physicians and healthcare providers by specialty, location, and other criteria. The Physician Search is an informational directory only and does not constitute a recommendation, referral, or endorsement of any individual provider.
3.3 Geographic Availability
Not all services are available in all states. Availability of Treatment Programs is subject to applicable state telehealth laws and the licensing jurisdictions of the applicable Provider Group. DocSearch makes no representation that any specific service will be available in your jurisdiction at any given time.
3.4 Service Changes
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.
Pursuant to the Associate Agreement between DocSearch and TelegraMD, all medical consultations conducted through the Platform are provided directly and exclusively by one of the following independent licensed Provider Groups, depending on the state in which you are located at the time of your consultation:
Provider Group | License Jurisdiction | Serves |
Online Medical Care, P.C. | New Jersey Professional Corporation | New Jersey and New York |
TMD of Kansas, P.A. | Kansas Professional Association | Kansas |
TMD of Texas, P.A. | Texas Professional Association | Texas |
TMD of CA, PC | California Professional Corporation | All other states |
All Prescription Products are dispensed and fulfilled by an independent licensed pharmacy engaged through the TelegraMD platform. The dispensing pharmacy is an independent entity and is not owned, operated, or employed by DocSearch. Prescription fulfillment and pharmacy services are provided directly by the Pharmacy and are subject to the Pharmacy’s own terms and conditions.
In accordance with DocSearch’s obligations under its agreement with TelegraMD, you have the following rights:
5.1 Right to Opt Out of Provider Group Assignment
You have the right to decline to use any specific Provider Group for your medical consultation. If you wish to request that your consultation not be conducted by a Provider affiliated with a specific Provider Group, you may exercise this right at any time before your consultation is conducted by contacting DocSearch at info@docsearch.com or +1 (407) 974-6808. We will work with TelegraMD to accommodate your request to the extent clinically and operationally feasible. Note that exercising this right may affect the availability or timing of services in your state.
5.2 Right to Opt Out of Pharmacy Assignment
You have the right to decline to use the default pharmacy partner assigned through the TelegraMD platform to fulfill your prescription. If you wish to request that your prescription be routed to a different licensed pharmacy, you may exercise this right by contacting DocSearch at info@docsearch.com before your prescription order is submitted. We will work with TelegraMD to accommodate your pharmacy preference to the extent permitted by applicable law and the prescribing Provider’s clinical judgment.
5.3 How to Exercise These Rights
To exercise either right, contact DocSearch’s patient support team at info@docsearch.com with the subject line “Provider / Pharmacy Opt-Out Request” and include your name and the specific change you are requesting. We will respond within two (2) business days.
To use the Platform, you must meet the following requirements:
By using the Platform, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet these requirements, you must not access or use the Platform.
Access to Telehealth Treatment Programs may be subject to additional eligibility requirements as determined by the treating Provider, including but not limited to medical history, current medications, contraindications, and state of residence.
7.1 Account Registration
Certain features of the Platform require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.
7.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@docsearch.com if you suspect any unauthorized use of your account or any security breach.
7.3 One Account per User
You may not create more than one account or create an account on behalf of another person without their express authorization. Creating duplicate accounts to circumvent a suspension or ban is prohibited and may result in permanent termination.
7.4 Accurate Health Information
When completing health intake forms or questionnaires, you agree to provide truthful, complete, and accurate information. Providing false or misleading health information may result in inappropriate medical treatment and poses serious risks to your health. DocSearch and the Provider Groups are not liable for adverse outcomes resulting from inaccurate information provided by users.
7.5 Account Termination by User
You may close your account at any time by contacting us at info@docsearch.com. Closing your account does not affect any outstanding payment obligations or the retention of records required by applicable law.
NOT FOR EMERGENCIES. DocSearch is not an emergency medical service. If you are experiencing a medical emergency, call 911 or proceed to your nearest emergency room immediately. Do not use this Platform for urgent or life-threatening conditions. |
8.1 No Doctor-Patient Relationship with DocSearch
The information provided on this Platform, including all health-related content, articles, blog posts, and general descriptions of treatments, is for informational purposes only. DocSearch does not provide medical advice, diagnoses, or treatment recommendations. No doctor-patient relationship is formed between you and DocSearch.
8.2 Independent Physicians
A doctor-patient relationship may be formed between you and a licensed Provider employed or contracted by a Provider Group who evaluates you through the Platform. This relationship is strictly between you and that Provider. The Provider’s clinical decisions, prescriptions, and recommendations are made independently and are not directed, reviewed, or approved by DocSearch.
8.3 No Guarantee of Treatment
Completing a health intake questionnaire does not guarantee that you will receive a prescription or be approved for any Treatment Program. Prescribing decisions are made at the sole discretion of the treating Provider based on clinical judgment and applicable medical and legal standards.
8.4 Medication Risks
All medications, including FDA-approved medications and compounded medications, carry risks and potential side effects. You should consult your treating Provider about all risks, benefits, contraindications, and alternatives before beginning any treatment.
8.5 Compounded Medications
Some Treatment Programs may utilize compounded medications prepared by licensed compounding pharmacies. Compounded medications are not FDA-approved finished drug products. They may contain the same active ingredients as FDA-approved medications but are not subject to the same FDA review for safety, efficacy, and quality. Your Provider will inform you if a compounded medication is recommended.
9.1 Consent to Telehealth
By accessing Telehealth Services, you consent to the delivery of healthcare services via electronic means, including through the TelegraMD platform, through secure online questionnaires, messaging, and video consultations where applicable. You understand that telehealth has both benefits and limitations compared to in-person care.
9.2 State Regulations
Telehealth is subject to varying laws by state. The Provider conducting your consultation is licensed through a Provider Group operating in the state in which you are located. You are responsible for ensuring that you are located in a state where the requested service is legally available at the time of your consultation.
9.3 Prescription Services
Where applicable, licensed Providers employed or contracted by the Provider Groups may issue prescriptions pursuant to a valid physician-patient relationship established through the telehealth encounter. Prescriptions are issued at the sole discretion of the Provider and are subject to applicable federal and state laws, including the Ryan Haight Online Pharmacy Consumer Protection Act where applicable.
9.4 Follow-Up Care
Telehealth services on this Platform do not replace your primary care physician or ongoing medical care. You are encouraged to share treatment information with your primary healthcare provider and to seek appropriate in-person care when clinically indicated.
9.5 Technical Requirements
You are responsible for obtaining and maintaining the technical equipment and internet connection necessary to access Telehealth Services. DocSearch is not liable for service interruptions caused by your equipment, internet service, or third-party technology providers.
10.1 Informational Purpose Only
The Physician Search tool is a free directory service intended to help users locate licensed healthcare providers. Inclusion of a provider in our directory does not constitute an endorsement, recommendation, or referral by DocSearch.
10.2 Accuracy of Listings
While we endeavor to maintain accurate and current provider information, DocSearch does not warrant the accuracy, completeness, or timeliness of any information in the Physician Search directory, including license status, specialty, contact information, or patient reviews.
10.3 Independent Verification
You are solely responsible for independently verifying the credentials, licensure, and qualifications of any provider you choose to contact or consult through the Physician Search directory. DocSearch strongly recommends verifying provider licensure through your state’s medical licensing board.
10.4 Patient Reviews
Patient reviews or ratings displayed in the Physician Search directory represent the opinions of individual users and do not reflect the views of DocSearch. We do not verify the accuracy of individual reviews. DocSearch reserves the right to remove reviews that violate our content standards.
10.5 No Fee for Search
The Physician Search tool is and will remain free to use for all patients. DocSearch does not charge physicians a fee to appear in standard search results, and providers cannot pay to achieve higher placement in organic search results.
11.1 DocSearch as Payment Facilitator
DocSearch acts as a payment facilitator on behalf of patients with respect to fees for medical services and Prescription Products. When you authorize a payment through the Platform, you are authorizing DocSearch to collect and transmit the applicable fees to the Provider Groups and Pharmacy on your behalf. DocSearch is not the merchant of record for clinical services; those services are provided directly by the Provider Groups and priced by TelegraMD in accordance with the Associate Agreement.
11.2 Pricing
The pricing for Treatment Programs is displayed on the Platform and may change from time to time. Any price changes will be communicated to active subscribers in advance. By initiating a Treatment Program, you authorize DocSearch to charge the applicable fees.
11.3 Subscription Programs
Many Treatment Programs are offered on a recurring subscription basis. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. You authorize DocSearch to charge your payment method on file for each renewal period.
11.4 Payment Methods
We accept major credit and debit cards and other payment methods as indicated on the Platform. You represent that you are authorized to use any payment method you provide. All payments are processed by third-party payment processors and are subject to their terms and privacy policies.
11.5 No Insurance Billing
DocSearch does not bill health insurance for any services. All Treatment Program fees are self-pay. Depending on your insurance plan, you may be able to seek reimbursement from your insurer independently; however, DocSearch does not provide insurance claims support or guarantees of reimbursement.
11.6 Refund Policy
Fees paid for completed physician consultations are generally non-refundable. For subscription programs, you may cancel at any time; however, we do not issue prorated refunds for unused portions of a billing period already charged, unless required by applicable law. Medication costs are non-refundable once dispensed by the Pharmacy, except where required by law. Refund requests should be submitted to info@docsearch.com.
11.7 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at info@docsearch.com. Cancellation takes effect at the end of the current billing period. Cancellation does not entitle you to a refund of any fees already charged.
11.8 Failed Payments
If a payment fails, DocSearch may retry the charge, suspend your access to Treatment Program services, or both. You are responsible for maintaining a valid payment method on file at all times.
Your Privacy Matters DocSearch is committed to protecting your personal information and health data. All protected health information is encrypted, stored securely, and handled in accordance with applicable federal and state privacy laws. |
12.1 Privacy Policy and HIPAA Notice
Your use of the Platform is subject to our Privacy Policy and HIPAA Notice of Privacy Practices, each incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and disclose your personal information. Our HIPAA Notice describes your rights and our obligations with respect to your Protected Health Information.
12.2 HIPAA Compliance — Business Associate Status
DocSearch operates as a Business Associate of TelegraMD’s Provider Groups under a HIPAA Business Associate Agreement executed pursuant to 45 CFR § 164.504(e). DocSearch complies with the applicable requirements of the HIPAA Privacy Rule, Security Rule, and the HITECH Act as they apply to Business Associates. DocSearch is not a Covered Entity under HIPAA; the Provider Groups are the Covered Entities responsible for your clinical records.
12.3 No Sale of Health Data
DocSearch does not sell your protected health information or identifiable health data to third parties for marketing or advertising purposes. We do not permit advertisers to pay to influence clinical content or treatment recommendations on the Platform.
12.4 Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your information in compliance with the HIPAA Security Rule. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
12.5 Authorization for Treatment-Related Communications
By enrolling in a Treatment Program, you authorize DocSearch and affiliated Providers to communicate with you via email, text message, or phone regarding your treatment, prescription status, refills, and related clinical matters, subject to your communication preferences set in your account.
12.6 Breach Notification
In the event of a breach of unsecured PHI, DocSearch will provide notifications in accordance with applicable law: to TelegraMD within ten (10) business days of DocSearch’s discovery of the breach; to affected Florida residents and the Florida Attorney General within thirty (30) calendar days per Fla. Stat. § 501.171; and to affected individuals and the U.S. Department of Health and Human Services Office for Civil Rights within sixty (60) days of discovery per 45 CFR §§ 164.404–164.414.
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. The following conduct is strictly prohibited:
Violation of these prohibited conduct standards may result in immediate suspension or termination of your account, referral to law enforcement, and civil liability.

Notwithstanding the foregoing, the cap in Section 15.4 shall not apply to, and DocSearch does not limit its liability for: (i) DocSearch’s own gross negligence or willful misconduct; (ii) death or bodily injury caused directly by DocSearch’s own acts or omissions; (iii) DocSearch’s own violation of applicable HIPAA or HITECH requirements; or (iv) liability that cannot be limited by applicable law.
15.5 Clinical Services Exclusion
DocSearch is not liable for any clinical outcomes, adverse events, medication side effects, misdiagnoses, or other consequences arising from services provided by the Provider Groups, individual Providers, or the Pharmacy.
